Mr Mobility is committed to protecting your privacy.

Mr Mobility (Pty) Ltd processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable South African law. This policy explains what we collect, why we use it, when we share it, how we protect it, and the rights available to you.

1. About This Policy

Mr Mobility is the responsible party for the personal information described in this policy. This policy applies when you visit mrmobility.co.za, create an account, make an enquiry, request a quotation, place an order, arrange delivery or collection, subscribe to communications, or otherwise interact with us.

"Personal information" has the meaning given in POPIA and includes information relating to an identifiable natural person and, where applicable, an identifiable juristic person.

2. Information We Collect

Depending on how you interact with us, we may collect:

  • identity and contact details, such as your name, telephone number, email address and delivery or billing address;
  • account, enquiry, quotation, order, rental, delivery, warranty and customer-service information;
  • transaction and payment-status information; payment-card details are generally processed directly by our payment provider;
  • product preferences and information you choose to provide about the intended user's mobility needs;
  • communications, reviews, feedback and marketing preferences; and
  • technical and usage information, such as IP address, device and browser type, referring pages, pages viewed and cookie identifiers.

Please do not provide health or other special personal information unless it is reasonably necessary for us to assist you. Where we process special personal information, we do so only where permitted by POPIA.

We collect information directly from you when you use the website, complete a form, contact us, place an order or otherwise communicate with us. We may also receive information from authorised representatives, payment and delivery providers, service partners, website technologies and publicly available sources, where lawful.

4. How We Use Information

We process personal information only where there is a lawful basis under POPIA, and only for a specific, lawful purpose. We may use it to:

  • respond to enquiries and provide product guidance, quotations and customer support;
  • process and fulfil orders, payments, deliveries, collections, returns, rentals, repairs and warranty claims;
  • create and administer customer accounts and maintain accurate business and transaction records;
  • prevent fraud, protect customers, secure our website and enforce our legal rights;
  • meet tax, accounting, consumer-protection and other legal obligations;
  • analyse and improve our website, products, services and customer experience; and
  • send marketing where you have consented or where otherwise permitted by law, with a clear way to opt out.

Depending on the activity, processing may be necessary to conclude or perform a contract with you, comply with a legal obligation, protect a legitimate interest of yours, pursue our legitimate interests or those of a third party, or may take place with your consent. Where we rely on consent, you may withdraw it at any time without affecting earlier lawful processing.

5. Sharing Information

We do not sell or rent personal information. We may share only the information reasonably necessary with trusted service providers and business partners that help us operate, including payment processors, couriers, cloud-hosting providers, IT support, analytics and marketing providers, professional advisers, and suppliers or technicians involved in fulfilling an order or service request.

We may also disclose information where required or permitted by law, to respond to lawful requests or court orders, to prevent fraud or harm, to protect our rights, or in connection with a lawful business reorganisation or transfer subject to appropriate protections.

These help the website function, remember choices, understand website use and measure communications or advertising. Cookie information may include device, browser, IP address and browsing activity.

You may opt out of electronic marketing at any time by using the unsubscribe method in the message or contacting us. Service communications about an order, account or enquiry are not marketing and may still be sent where necessary.

7. Processing Outside South Africa

Some trusted third-party service providers, such as cloud-hosting, analytics, marketing or payment providers, may process or store personal information outside South Africa. Where personal information is transferred outside the Republic, we implement appropriate safeguards in accordance with POPIA, such as ensuring that the recipient is subject to an adequate law, binding rules or an agreement providing an adequate level of protection, or relying on another lawful ground permitted by POPIA.

8. Retention and Security

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, to meet contractual and legal obligations, resolve disputes and enforce agreements. We then securely delete, destroy or de-identify it, unless further retention is required or permitted by law.

We use reasonable technical and organisational safeguards appropriate to the nature of the information, including access controls and security measures designed to prevent loss, unauthorised access, interference, modification, disclosure or destruction. No internet transmission or storage system is completely secure, but we regularly consider and improve our safeguards.

If a security compromise involving your personal information occurs, we will notify the Information Regulator and affected persons where required by POPIA.

9. Your Rights

Subject to POPIA and other applicable law, you may:

  • request confirmation of whether we hold personal information about you and request access to it;
  • request correction or updating of inaccurate, incomplete, misleading or out-of-date information;
  • request deletion or destruction of personal information where permitted by law;
  • object to certain processing and withdraw consent where processing is based on consent; and
  • lodge a complaint with the South African Information Regulator if you believe your personal information has been processed contrary to POPIA.

To exercise a right, email info@mrmobility.co.za. We may ask for reasonable proof of identity to protect your information and will respond within the period required by law. A request may be subject to lawful grounds for refusal, retention requirements and any fee permitted by law.

10. Children and External Links

Our website is not directed at children, and we do not intentionally collect children's personal information without the consent of a competent person or another lawful basis. If you believe a child has provided information to us improperly, please contact us.

The website may contain links to independent third-party websites. Their privacy practices are governed by their own notices, which we encourage you to review.
