Terms & Conditions

The terms that govern your use of the Mr Mobility website and purchases from us. Please read them carefully.

Welcome to Mr Mobility. These Terms & Conditions ("Terms") apply when you access mrmobility.co.za (the "website"), contact us through it, or purchase goods or services from Mr Mobility (Pty) Ltd ("Mr Mobility", "we", "us" or "our").

By using the website or placing an order, you agree to these Terms and the policies referred to in them. Nothing in these Terms limits or excludes any rights or remedies afforded to consumers under applicable South African legislation, including the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and the Protection of Personal Information Act 4 of 2013 (POPIA). If these Terms conflict with a mandatory provision of law, that provision will prevail.

1. Using the Website

You may use the website only for lawful purposes. If you are under 18 or otherwise lack full legal capacity, you may use the website and place an order only with the involvement and consent of a parent, guardian or other person legally authorised to assist you.

You must not introduce malicious code, interfere with the website's operation, attempt unauthorised access, or use our content or services in a way that infringes the rights of another person. We may suspend access where reasonably necessary to protect the website, our customers or our business.

2. Information and Availability

We take reasonable care to keep website information accurate and current. Product descriptions, images, dimensions, stock levels, availability and delivery estimates may nevertheless change or contain an error. Images are illustrative and colours may vary between displays.

We may correct an obvious error or update information at any time. If an error materially affects an order already placed, we will contact you and offer an appropriate remedy, which may include confirming the corrected order or cancelling it and refunding amounts paid.

3. Products and Services

Products and services are offered subject to availability and any limitations stated on the website. You are responsible for checking that a product is suitable for the intended user and environment and for following all supplied safety, assembly, operating, weight-limit and maintenance instructions.

Website content is general product information and is not a substitute for advice from a suitably qualified healthcare professional where clinical or individual assessment is required. Any product warranty is subject to its stated terms and applicable law.

4. Orders and Acceptance

Submitting an order is an offer to purchase. We may accept or decline it for a lawful reason, including unavailability, an obvious pricing or description error, payment failure, suspected fraud, or delivery restrictions. A binding sale is concluded when we send confirmation that we have accepted the order or dispatch the goods, whichever occurs first.

We may limit quantities reasonably and may contact you to verify order information. If we decline or cancel an order after receiving payment, we will refund the affected amount using the original payment method where reasonably possible.

5. Prices and Payment

Prices are displayed in South African rand. Unless clearly stated otherwise, displayed consumer prices include VAT where applicable. Delivery, installation or other charges will be disclosed before you complete the order.

Payment must be made using an available payment method. Payment providers may apply their own terms and security checks. We do not store full payment-card details where payment is processed directly by an authorised payment provider.

6. Delivery and Collection

Delivery or collection arrangements, charges and estimated timeframes will be shown during checkout or agreed with you. Estimates are not guarantees, but we will take reasonable steps to deliver within the agreed period and will communicate material delays.

You must provide accurate delivery details and ensure that an authorised person can receive the order. Risk passes as provided by applicable law. Ownership remains with Mr Mobility until full payment has been received.

7. Returns, Refunds and Cancellations

Returns, exchanges, refunds and order cancellations are handled under our Returns Policy and applicable South African law. The Returns Policy forms part of these Terms.

Any exclusions or conditions in that policy apply only to the extent permitted by law and do not limit rights relating to defective, unsafe or incorrectly supplied goods, or any other non-excludable consumer right.

8. Accounts and Customer Information

You must provide information that is current, complete and accurate and keep account credentials confidential. You are responsible for activity under your account unless the activity results from our failure to apply reasonable security safeguards. Tell us promptly if you suspect unauthorised use.

9. Third-Party Services and Links

The website may link to or use services operated by independent third parties, including payment, mapping, analytics or social-media providers. Links are provided for convenience and do not mean that we control or endorse all third-party content. Your use of a third-party service may be governed by that provider's terms and privacy notice.

To the extent permitted by law, we are not responsible for independent third-party websites or services outside our reasonable control.

10. Intellectual Property

The website's design, text, graphics, logos, photographs and other content are owned by or licensed to Mr Mobility and are protected by applicable intellectual-property laws. You may view and make a reasonable personal copy for lawful, non-commercial use. You may not reproduce, modify, distribute, sell or commercially exploit the content without prior written permission.

Third-party trade marks and content remain the property of their respective owners.

11. Reviews and Submissions

If you submit a review, suggestion, image or other content, you confirm that it is accurate, lawful, your own or properly authorised, and does not infringe another person's rights. You grant us a non-exclusive, royalty-free licence to use, reproduce and display that content for purposes connected with our business and services.

We may moderate or remove content that is unlawful, misleading, abusive, irrelevant or otherwise breaches these Terms. We will not publish personal information unnecessarily.

12. Prohibited Uses

You may not use the website to commit or encourage unlawful conduct; infringe intellectual-property, privacy or other rights; harass or discriminate against another person; submit false or misleading information; distribute malware or unsolicited communications; scrape or collect information without authority; or defeat any security or access-control measure.

13. Personal Information

We process personal information in accordance with POPIA and our Privacy Policy. The Privacy Policy explains what we collect, why we use it, when we share it, cross-border processing, security measures, retention and your rights.

14. Warranties and Limitation of Liability

We do not promise that the website will always be uninterrupted, secure or error-free. To the extent permitted by law, the website and its general information are provided as available and without warranties other than those expressly given or imposed by law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including rights and remedies under the CPA. Subject to that qualification, Mr Mobility will not be liable for indirect, special or consequential loss that was not reasonably foreseeable when the relevant agreement was concluded, or for loss caused by circumstances beyond our reasonable control. Any limitation will apply only to the maximum extent permitted by South African law.

15. Indemnity

To the extent permitted by law, you indemnify Mr Mobility against third-party claims, losses or reasonable costs arising directly from your unlawful use of the website, your infringement of another person's rights, or content you submit in breach of these Terms. This clause does not apply to the extent that a claim results from Mr Mobility's own conduct or where an indemnity is prohibited by law.

16. Termination, Severability and Entire Agreement

You may stop using the website at any time. We may suspend or end access where you materially breach these Terms, subject to any notice or other right required by law. Rights and obligations that arose before termination continue where their nature requires it.

If a provision is unlawful or unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will continue. These Terms, together with the policies and order-specific terms referred to in them, form the agreement between you and Mr Mobility concerning the website and your purchase. A failure to enforce a right is not a waiver of that right.

17. Governing Law and Disputes

These Terms, the website and any agreement between you and Mr Mobility are governed by the laws of the Republic of South Africa. Any dispute will be subject to the jurisdiction of the South African courts, without preventing a consumer from using any complaint, ombud, regulator or other dispute-resolution process available under applicable law.

Please contact us first so that we can try to resolve a concern promptly and fairly.

18. Changes and Contact Details

We may update these Terms when our services, business practices or legal obligations change. The revised version will be published on this page with an updated date and will apply from publication, except where law requires notice or consent. Changes will not retrospectively reduce rights already accrued.
